At Pardee Homes of Nevada (“Company”, “we”, “us” or “our”), we value our relationship with brokers/agents like you.  With that in mind, we have prepared a Broker Co-Op / Referral Fee Agreement (which is available at all of our New Home Galleries) with eligibility conditions and sample referral fee calculations (some of which are referenced below) to help you take advantage of the opportunities we offer.  In the event of any conflict between the below terms and those listed in the Broker Co-Op / Referral Fee Agreement, the Broker Co-Op / Referral Fee Agreement will control.  We’ve taken great care to spell out these terms in an effort to ensure that you, your brokerage company, and your clients have a clear understanding of what’s required.  We reserve the right to modify or terminate this referral fee program at any time without notice.  Please see a New Home Advisor for further details.

CONDITIONS TO RECEIPT OF A REFERRAL FEE:

  1. You must physically accompany and personally register your client (i.e., the Buyer or the Buyer’s spouse) on their FIRST visit to the participating neighborhood of their choice.  If your client has previously visited the community, registered on our interest registry or the interest list of the master developer for the community in which our neighborhood is located (if any), no referral fee will be paid. 
  2. You must register in writing as the agent or broker for your client by completing, executing and delivering to us an original Broker Co-Op / Referral Fee Agreement.  You can obtain a copy of the agreement from any of our New Home Advisors at the New Home Gallery of the community in which your client is interested.
  3. When you register your client, that registration will be effective for sixty (60) days.  If your client has not executed a Purchase Agreement prior to the expiration of the sixty (60) day period, the registration automatically lapses and no referral fee will be paid.
  4. Your client must execute a Purchase Agreement within the registration period, we must accept the Purchase Agreement in writing, and your client must close escrow on the property in accordance with the terms of the Purchase Agreement.  All of the foregoing must occur in the neighborhood to which you have introduced and registered your client.  If your client purchases a home in a different neighborhood, no referral fee will be paid.
  5. The referral fee will be paid through, and upon the close of, escrow to the licensed brokerage company listed on the Broker Co-Op / Referral Fee Agreement (i.e., not you directly) if and only if:

(a) the agent or broker listed in the Broker Co-Op / Referral Fee Agreement is still employed by said brokerage;
(b) the licenses of the agent or broker and brokerage are active and in good standing in the state in which the property is located;  
(c) Buyer’s position under the Purchase Agreement is not assigned (either with or without our prior written consent) and someone originally named as “Buyer” in the Purchase Agreement is a buyer thereunder at close of escrow;
(d) escrow closes; and
(e) Buyer (or Buyer’s spouse, or anyone named as “Buyer” under the Purchase Agreement at the close of escrow, or the spouse of any such person) has not visited the neighborhood in which the Buyer purchased the property with another agent or broker (i.e., an agent or broker other than you) who has executed a Broker Co-Op / Referral Fee Agreement under which we are obligated to pay a referral fee or commission.

If all of the foregoing conditions have not been met, we will not pay a referral fee.  Conversely, if all of the foregoing condition have been met, we will pay your brokerage company a referral fee equal to 3% of the Base Purchase Price of the property less any Home Discount (capitalized terms shall have the meanings ascribed to them in the Purchase Agreement).  Please see the Broker Co-Op / Referral Fee Agreement for details.

Importantly, should an agent or broker charge a transaction fee, said fee shall be paid exclusively by the Buyer.  We have no obligation to pay, and will not pay, any such transaction fee.  Further, our New Home Advisors are our exclusive agents in all transactions and will not represent the Buyer in any capacity (see Nevada Division of Real Estate form 525/525A, Duties Owed by a Nevada Real Estate Licensee, regarding real estate agency relationships).
